1. Acceptance of Terms

By accessing or using Beacon's AI brand monitoring platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Beacon provides an AI brand monitoring platform that helps enterprises understand and manage how AI systems represent their brand across large language models. Our services include brand visibility monitoring, accuracy tracking, narrative analysis, readiness assessments, and optimization recommendations. The Service generates insights by querying AI models and comparing their responses against your brand's published information.

3. User Accounts

You must create an account to use the Service. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or use
• Ensuring that account information is accurate and up to date

We may suspend or terminate accounts that violate these Terms or remain inactive for an extended period.

4. Acceptable Use

You agree not to:

• Use the Service to violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service, servers, or networks
• Transmit any malicious code, viruses, or harmful content
• Use the Service to monitor brands you do not have authorization to manage
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape or extract data from the Service beyond its intended API
• Resell or redistribute the Service without our written consent

5. Intellectual Property

Our IP: The Beacon platform, including its software, design, documentation, and branding, is owned by Beacon AI Technologies, LLC and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

Your Data: You retain all rights to the brand data and content you provide to Beacon. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service. We do not claim ownership of your data and will not use it for any purpose other than delivering the Service to you.

6. AI-Generated Content

The Service generates analysis and recommendations using AI models. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. Beacon does not guarantee the accuracy, completeness, or reliability of AI-generated outputs. You should independently verify any critical information before making business decisions based on our analysis.

7. Service Availability

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

8. Payment Terms

If you subscribe to a paid plan, you agree to pay all applicable fees as described in your subscription agreement. Fees are non-refundable except as required by law or as otherwise stated in your agreement. We reserve the right to modify pricing with 30 days' prior notice.

9. Limitation of Liability

To the maximum extent permitted by law, Beacon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, resulting from your use of the Service. Our total liability for any claims arising from these Terms shall not exceed the amounts you paid to Beacon in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Beacon, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

Either party may terminate these Terms at any time. You may stop using the Service and request account deletion. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Upon receiving a deletion request, we will delete your data within 30 days. If you terminate your account but do not request deletion, we will automatically delete your data within 12 months. Retention beyond these periods occurs only where required by law.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Beacon AI Technologies, LLC is a Delaware limited liability company operating in California. Any disputes arising from these Terms shall be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association. Either party may seek injunctive relief in a court of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will provide additional notice via email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
